Our duty to you with regards to the protection of Personal Information Act 4 Of 2013.

  1. We are obliged to comply with The Protection of Personal Information Act (“POPI”). It mainly refers to the manner in which we must process your personal information whilst executing our mandate as a Bursary Trust.

  2. POPI balances two interests, being:
    • Your constitutional right to privacy; and
    • The needs of our society to have access to and to use your personal information for legitimate and lawful purposes.

  3. In terms of POPI we are obliged to inform you of how we process your personal information. It is as follows:
    • We mainly collect most of your personal information directly from you. In some cases we obtain such information from a third party being an academic institution, tracers, credit bureaux and public documents.
    • We will use your personal information that we collect to enable us to fulfil our mandate. This could be for the application of a bursary, bursary agreement and or related tasks.
    • With regards to Financial Intelligence Centre Act (FICA) you are legally bound to furnish us with any information that they may require. FICA is in place to prevent money laundering and the financing of terrorism. The same applies to the South African Revenue Services (SARS).
    • It is your personal choice whether you want to furnish us with your personal information but if you fail to do so we will not be able to execute our mandate properly. In some cases you may also be in breach of contract.
    • Your personal information will be shared with the necessary authorities that is required to executing our mandate such as The South African Revenue as an example and so forth.
    • You should have absolute peace of mind that we will only share your personal information where are legally bound to do so and when required in order to execute our mandate.
    • At any time you have the right of access to your personal information and the right to correct any errors relating to the information that we have on record. You may also exercise your right to object to us continuing to process your personal information.
    • If your work attracts an international element we urge you to enquire about those countries laws and how they will protect your information.
    • Our file is closed once our mandate is completed with you and the records are destroyed after a certain period of time has passed. Whilst the file is with us your personal information will remain protected. Thereafter your personal information will be destroyed together with the file.

  4. The security on our systems are as follows:
    • All personal information is stored on our internal server which runs on Windows 10 Professional. The data is backed up on external hard drives which is placed in a safe on site. Our email emanates from Telkom as our service provider and is compliant with security safeguards the standard European Union requirements of General Data Protection Regulation (GDPR).
    • We make use of recognised Firewall and anti-virus software on our entire network of PCs and server to protect the data.
    • Should you have any issues with the way in which we are processing your personal information, you are entitled to lodge a complaint with the Information Regulator, whose contact details are: complaints.IR@justice.gov.za
